Temporary Disability Rates to Rise Again on January 1, 2008

The Division of Workers' Compensation announced new temporary disability rates effective January 1, 2008 due to a rise in the State Average Weekly Wage pursuant to Labor Code Section 4453(a)(10).

Beginning January 1, 2008, the new maximum temporary disability rate will be $916.33 with a new minimum temporary disability rate of $137.45.

For the time frame considered in calculating the increase, the year preceding March 31, 2007, the state average weekly wage rose 3.932%, causing an equivalent rise in the temporary disability rates under the reforms set forth in SB 899, under Labor Code Section 4453(a)(10).
