LEGAL CASE OVERVIEW
Floyd, Skeren & Kelly represents insurance carriers, third party administrators, city agencies, county agencies, and employers. We defend all aspects of workers' compensation claims including 132a discrimination claims, claims for serious and willful misconduct, and subrogation claims. Furthermore, we coordinate defenses pertaining to ADA and FEHA claims.
APPEARANCES AT WORKERS' COMPENSATION APPEALS BOARDS
We make appearances at all Workers' Compensation Appeals Boards throughout California, including Anaheim, Bakersfield, Eureka, Fresno, Goleta, Grover Beach, Long Beach, Los Angeles, Oakland, Oxnard, Pomona, Redding, Riverside, Sacramento, Salinas, San Bernardino, San Diego, San Francisco, San Jose, Santa Ana, Santa Monica, Santa Rosa, Stockton and Van Nuys.
We represent clients before the Nevada Department of Admininstration through our Las Vegas office.
SPECIAL INVESTIGATION UNIT
Amanda Manukian is the chairperson of our Special Investigation Unit. Ms. Manukian was an Assistant Deputy District Attorney for the Los Angeles District Attorney's Office and later served as the Fraud Liaison for the State Compensation Insurance Fund.
Terry Smith, the Managing Attorney in charge of the Thousand Oaks office, is also a member of the SIU. Mr. Smith's background in special investigations includes 13 years as a deputy sheriff with the Ventura County Sheriff's Department. He has also worked at the Ventura County District Attorney's Office and served as the Special Investigation Unit Attorney at a major insurance carrier.

APPELLATE UNIT
Judge David W. O'Brien (retired) is the chairperson of our Appellate Department. He is the foremost expert on workers' compensation in California. Judge O'Brien is the author of the definitive treatise, California Workers' Compensation Claims and Benefits, CA Workers' Compensation Insurance Employee Rights and Responsibilities, as well as other titles including California Unemployment and Disability Compensation Programs.
SUBROGATION UNIT
Norman F. Boxley heads our Subrogation Unit and is the Managing Attorney of our firm’s Liability Defense/Subrogation office in Pasadena. Other members of this unit are John M. Langevin in Riverside and David Weitzman in our San Fernando Valley Office. Our Pasadena office handles all of the firm's civil litigation and general liability defense.
LIEN UNIT
Hearing Representative Walter Hesse manages FS&K's Lien Unit. He has extensive knowledge of the Official Medical Fee Schedule and decades of experience litigating medical treatment and medical/legal liens.
CLIENT TRAINING
FS&K conducts seminars on California Workers' Compensation Law. These seminars, led by Judge O'Brien, are specifically tailored for our individual clients' needs. We have conducted seminars on broad topics such as, "How Does the New Law Impact Your Business?" as well as specific topics like, "How to Avoid 132a Claims." FEE ARRANGEMENT
FS&K's typical fee agreement provides for a tiered hourly rate for Partners, Retired Judges, Managing Attorneys, Senior Associates, as well as for Paralegal/Paraprofessional time.
Our billing system is comprised of established guidelines and mulitple layers of oversight to help ensure consistent, predictable, and reasonable billings. When you receive a bill from Floyd, Skeren & Kelly, you can be certain that no legal activity is billed at an excessive rate. There are maximum and minimum charges. We bill in six-minute increments. Appearances at the Workers' Compensation Appeals Board are reflected in our billing as 3.0 hours or the actual time incurred, whichever is greater. As an exception to this policy, where Floyd, Skeren & Kelly does not have a "local" office, the appearance will be billed at four hours minimum with pre-negotiated charges for travel time.
We thoroughly examine all bills by looking at each category of employee, attorney, paraprofessional, and hearing representative, and pay careful attention to how much time each employee exhausts on average for each activity. Our bills reflect a reasonable amount of time required to complete each specific activity. This is not task billing per se, but merely a constraint upon our attorneys to bill for individual activities within certain range determined to be reasonable. Attorneys are not to bill in excess of the guideline's maximum regardless of the actual time worked. This helps prevent anomalous spikes in billing and assists our clients in effectively managing and predicting litigation costs.
